Do you regularly work abroad or are you temporarily seconded abroad?

Then it is important to check in which country you must pay tax and in which country you have social insurance!

For many employees, working abroad is an attractive employee benefit. And you see something of the world, which is a nice additional benefit. Especially when everything is well organised, you can keep this up for quite a while. However, in our practice, we regularly see problems arise because there are all kinds of formalities of which the employer and employee were not aware. Such as a WagwEU (Posted Workers in the European Union (Working Conditions) Act) reporting requirement in the Netherlands or a Limosa reporting requirement in Belgium. Or a tax audit that suddenly leaves you with a high additional tax assessment, because you have mistakenly paid tax abroad, and not in the UK. Ambiguities about customs formalities in the context of Brexit could also throw a spanner in the works.

There are a lot of misconceptions about working abroad, which result in not taking the right steps or missing certain steps. In addition, knowledge of the subject of cross-border working is spread across various government bodies. As a result, you will often receive an incomplete answer when you turn to them. Or contradictory answers from different authorities, because they simply do not have all the pieces of the “Cross-border employment” puzzle.

What can you do at your own initiative?

In the first instance, you can ask the employer itself for clarity. If necessary, you can use our information above to inform the employer about the rules. This information is also available in Dutch, German, and French.

If you are a member of a trade union, you may also turn to them for advice.

If you are unable to solve the problem yourself, your employer can also contact their own payroll provider, if this party is familiar with working across borders. However, many local payroll providers do not have the relevant experience, so they cannot always adequately answer questions about which rules apply.
