Secondment to the Netherlands? As from 1 March 2020, registration is mandatory!
What does this mean?
The rules are applicable to foreign (non-Dutch) employees and self-employed contractors seconded to the Netherlands on a temporary basis for providing cross-border services. The starting point of this Act is that for these employees, a number of basic employee benefits apply, and in some cases the applicable CLA.
A key section of the WagwEU is mandatory registration prior to starting the work.
How about mandatory registration in the Netherlands?
From 1 March 2020, any cross-border work must be registered with the “Meldloket WagwEU” (Notification portal for WagwEU), an online system of the Dutch government.
However, this system will become operational on 1 February 2020.
A foreign employer must at least report the following details:
- the reporter’s identity
- the company details
- the contact as referred to in Section 7 of the WagwEU
- information regarding the client/user company’s identity
- the sector of the relevant activities in the Netherlands
- the employee’s work address
- the expected duration of the work
- the identity of the person responsible for payment of wages
- the identity of the employees to be seconded to the Netherlands
- the availability of an A1 declaration or other evidence showing where social security contributions are paid for the employee/employees, in the context of the contribution for the relevant social security schemes.
